Terms of Service

1. Acceptance of Terms

By accessing or using PolyGlyph ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.

These Terms constitute a legally binding agreement between you and PolyGlyph. We may update these Terms from time to time, and your continued use of the Service following any changes constitutes acceptance of the revised Terms.

You represent that you are at least 13 years of age and have the legal capacity to enter into these Terms. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

2. Description of Service

PolyGlyph is an AI-powered SVG generation and editing platform. The Service provides the following capabilities:

• AI SVG Generation. Text-to-vector generation using AI image synthesis and automated vectorization. You provide a text prompt, and the Service generates an editable SVG file.
• Vector Editing. A browser-based editor for modifying generated SVGs, including layer management, color editing, transformations, and path editing.
• Export. The ability to export your work as SVG or PNG files for use in other applications.
• API Access. A programmatic interface for generating SVGs from text prompts, available to registered users with valid API keys.

3. Account Registration

To use PolyGlyph, you must create an account using a valid email address through Firebase Authentication. You are responsible for maintaining the security of your account credentials.

Each person may maintain only one account. Creating multiple accounts to circumvent credit limits, rate limits, or enforcement actions is prohibited and may result in termination of all associated accounts.

You agree to provide accurate information during registration and to keep your account information current. You are responsible for all activity that occurs under your account.

You must notify us immediately if you become aware of any unauthorized access to or use of your account.

4. Credits and Payments

PolyGlyph operates on a credit-based system. Key terms:

• Signup Bonus. New accounts receive free credits upon registration to explore the Service.
• Credit Cost. Each generation consumes one credit. Credits are deducted when a generation begins processing.
• Purchasing Credits. Additional credits can be purchased through the Service. All payments are processed securely by Stripe. Prices are displayed at the time of purchase and are subject to change.
• Auto-Refund on Failure. If a generation fails due to a system error, the credit consumed for that generation is automatically refunded to your account.
• No Refunds on Used Credits. Credits that have been successfully used for generations are non-refundable. Unused purchased credits may be eligible for a refund at our discretion within 14 days of purchase.
• Credit Expiration. Credits do not expire as long as your account remains active.

All purchases are final unless otherwise stated. You are responsible for any applicable taxes on your purchases.

5. Generated Content & Intellectual Property

Your Ownership. You own the SVG and PNG files generated through PolyGlyph. Subject to these Terms, you are free to use your generated content for any lawful purpose, including commercial use, without attribution to PolyGlyph.

License to PolyGlyph. By using the Service, you grant PolyGlyph a non-exclusive, worldwide, royalty-free license to process, store, and transmit your content (including prompts and generated files) solely for the purpose of providing and improving the Service. This license is limited to what is technically necessary to operate the platform.

No Uniqueness Guarantee. AI-generated content may produce similar or identical results for similar prompts submitted by different users. PolyGlyph does not guarantee the uniqueness of any generated content.

PolyGlyph IP. The Service itself — including the platform, editor, pipeline, brand, and documentation — is the intellectual property of PolyGlyph and is protected by applicable laws. These Terms do not grant you any rights to PolyGlyph's intellectual property beyond the right to use the Service as described herein.

6. API Usage

The PolyGlyph API is available to registered users who create API keys through the editor. API usage is subject to the following terms:

• Rate Limits. API requests are rate-limited to 60 requests per minute per API key and 1,000 requests per day per account. These limits are subject to change.
• Fair Use. The API is intended for legitimate SVG generation use cases. Automated abuse, excessive request volumes designed to degrade the Service, or using the API to build a competing service is prohibited.
• Key Security. You are responsible for keeping your API keys secure. Do not expose API keys in client-side code, public repositories, or browser requests. You are responsible for all usage associated with your API keys.
• Key Limits. Each account may have a maximum of 5 active API keys at any time.
• Credits. API generations consume credits at the same rate as editor generations (one credit per generation).

We reserve the right to revoke API keys or restrict API access for accounts that violate these terms or engage in abusive behavior.

7. Acceptable Use

You agree to use PolyGlyph only for lawful purposes and in compliance with these Terms. You agree not to:

• Use the Service to generate content that violates any applicable law or regulation.
• Attempt to reverse-engineer, decompile, or extract the source code of the generation pipeline, vectorization process, or any other proprietary component of the Service.
• Circumvent or attempt to circumvent rate limits, credit requirements, authentication, or other technical measures.
• Interfere with or disrupt the integrity or performance of the Service or its infrastructure.
• Access or attempt to access another user's account, generations, or data without authorization.
• Use automated tools to scrape, crawl, or extract data from the Service outside of the provided API.
• Resell or redistribute access to the Service without authorization.

8. Prohibited Content

You may not use PolyGlyph to generate, store, or distribute the following types of content:

• Child Sexual Abuse Material (CSAM). Any content depicting the sexual exploitation or abuse of minors is strictly prohibited and will be reported to the appropriate authorities.
• Hateful Content. Content that promotes hatred, discrimination, or violence against individuals or groups based on race, ethnicity, religion, gender, sexual orientation, disability, or other protected characteristics.
• Violent Content. Graphic depictions of violence, gore, or content that glorifies or incites real-world violence.
• Impersonation. Content designed to impersonate specific individuals, organizations, or brands for deceptive or fraudulent purposes.
• Illegal Content. Content that facilitates or promotes illegal activities, including fraud, counterfeiting, or the creation of deceptive documents.

We reserve the right to remove prohibited content and terminate accounts that violate these restrictions without notice.

9. Service Availability

We strive to keep PolyGlyph available and reliable, but we operate on a best-effort basis. We do not provide a Service Level Agreement (SLA) or guarantee any specific uptime percentage.

The Service may be temporarily unavailable due to maintenance, updates, third-party service disruptions (including our AI generation and vectorization providers), or circumstances beyond our control.

We will make reasonable efforts to notify users of planned maintenance that may affect availability.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, POLYGLYPH AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.

IN NO EVENT SHALL POLYGLYPH'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE EXCEED THE AMOUNT YOU HAVE PAID TO POLYGLYPH IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

11. Indemnification

You agree to indemnify, defend, and hold harmless PolyGlyph and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorney's fees) arising out of or in connection with:

• Your use of the Service.
• Content you generate, upload, or distribute through the Service.
• Your violation of these Terms.
• Your violation of any rights of a third party.

12. Modifications to Service

We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time, with or without notice. This includes changes to features, functionality, credit pricing, rate limits, and supported generation types.

For material changes that significantly affect your use of the Service, we will make reasonable efforts to provide advance notice via email or through the Service interface.

We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.

13. Termination

By PolyGlyph. We may suspend or terminate your account at any time if you violate these Terms, engage in prohibited conduct, or for any other reason at our sole discretion. In cases of violation, termination may be immediate and without prior notice.

By You. You may delete your account at any time by contacting us at support@polyglyph.io. Upon account deletion, your personal data and generated files will be removed in accordance with our Privacy Policy.

Effect of Termination. Upon termination, your right to use the Service ceases immediately. Any unused credits in your account at the time of termination are forfeited and non-refundable, except where required by applicable law.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of laws provisions.

Any legal action or proceeding arising out of or relating to these Terms shall be brought exclusively in the federal or state courts located in Delaware, and you consent to the personal jurisdiction of such courts.

15. Dispute Resolution

Before initiating any formal legal proceeding, you agree to first attempt to resolve any dispute informally by contacting us at support@polyglyph.io. We will attempt to resolve the dispute through good-faith negotiation within 30 days.

If the dispute cannot be resolved informally, either party may pursue resolution through the courts as specified in the Governing Law section above.

You agree that any dispute resolution proceedings will be conducted on an individual basis and not as part of a class, consolidated, or representative action.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions of these Terms shall remain in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and PolyGlyph regarding your use of the Service. These Terms supersede any prior agreements, communications, or understandings, whether written or oral, relating to the subject matter herein.

No waiver of any term or condition of these Terms shall be deemed a further or continuing waiver of such term or any other term, and PolyGlyph's failure to assert any right or provision under these Terms shall not constitute a waiver of such right or provision.
